These Repair Terms and Conditions (hereinafter referred to as these Terms) govern the repair services performed by Apple Asia Limited Taiwan Branch (hereinafter referred to as Apple) for your product. If you want to read written terms, please request a paper copy.
1. Apple will provide repair for your product according to the charge described and indicated in the previous picture plus applicable tax. During your visit to Apple Store, each customer may have only one (1) product repaired. If Apple's protection or extended repair contract or the Consumer Protection Act covers repair, such contract or applicable laws shall apply. Before providing repair services for your product, Apple may require you to provide a valid purchase certificate. If you fail to do so, Apple may refuse to provide repair services for your product.
Apple understands that your data may be very valuable to you. There is always the possibility of data loss during the repair process, and in some cases, data may be irrecoverable, deleted or reformatted. In view of this, you have the responsibility to back up all the existing data, software and/or programs in your product and decide whether to remove such data from your product before sending it for repair. Apple will not be responsible for the loss, recovery or damage of data, software or programs, or the loss of use value of your product or other device, arising from the repair provided by Apple. You declare that your product does not contain any illegal files or data.
You understand that your device may be sent by a transportation operator to an external repair center for repair. In view of this, we suggest that you back up your device and delete relevant data before sending it for repair.
2. If your product has to be repaired due to the failure of non-original parts, or product damage caused by abuse, improper use or any external factors, Apple reserves the right to return the product to you without repair, and require you to bear all indicated diagnostic charges. Apple will not be responsible for product damage arising from unauthorized modification, repair or replacement by any non-Apple employee or non-Apple Authorized Service Provider (AASP) during the repair process. In case of damage, Apple will still seek your authorization for the additional charges required to complete the repair, even if the product is covered by the warranty or AppleCare service plan. If you refuse to provide authorization, Apple will have to return your damaged and unrepaired product without any responsibility.
3. If the manpower and/or parts required for repair are not recorded in the previous picture, Apple may seek your consent for the revised estimate. If you do not agree with Apple's revised charge, Apple may return the product and require you to bear all indicated diagnostic charges.
4. Apple may use brand-new parts or products, or parts or products with reliability and efficiency equivalent to those of brand-new items. Apple will retain replaced parts or products as Apple's property, and replacement parts will become your property. The replaced parts are usually repairable, and will be exchanged or repaired by Apple for paid purposes. If Apple is required by applicable laws to return the replaced parts to you, you agree to pay Apple the additional charge of the replacement items.
5. Apple warrants (1) that it will repair the product with perfect and sophisticated technology, and (2) that all parts used to repair the product will not have any material and manufacturing defects within ninety (90) days after repair unless otherwise specified by Apple. The foregoing warranty is an express limited warranty. In case of breach of such warranty, Apple will (i) repair again, (ii) repair or replace the parts, or (iii) refund the repair charge. This warranty and related remedies are the sole and only warranties of liability and will supersede all other express or implied warranties, remedies and conditions stated orally or in writing. Apple specifically disclaims any implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose. If Apple cannot exclude implied warranties in a legal manner, the validity period of all such warranties is limited to the validity period of express limited warranties. Some states (countries or regions and provinces) do not allow restrictions on the validity period of implied warranties (or conditions), so the above restrictions may not apply to you.
6. To the maximum extent permitted by law, Apple and its affiliates will in no case be responsible for any special, indirect, incidental or consequential damages arising from provision of repair services or compliance with any other legal theory, including but not limited to loss of revenue; actual or expected loss of profit (including loss of contract profit); loss of monetary use; expected loss of savings; business loss; opportunity loss; loss of goodwill; reputation loss; data loss, damage or destruction; or costs and expenses incurred for replying to, writing or recovering any program or data stored through your product or used with your product, and for failing to prevent the data stored in the product from being leaked. The foregoing restrictions shall not apply to claims for death or personal injury. Apple does not specifically warrant (i) that repairing or replacing the product will not result in the risk of loss of programs or data, and (ii) that the confidentiality of the data will be maintained. If any product is damaged or lost in Apple's custody, Apple's liability will be limited to assumption of the charge for repairing or replacing the affected product. In addition, Apple's liability for any and all damages shall in no case exceed the amount of money received by Apple in providing repair services according to these Terms. If Apple breaches these Terms and Conditions, the remedies specified in these Terms shall be your sole and exclusive remedies. Some states (countries or regions and provinces) do not allow exceptions or restrictions on incidental or consequential damages, so the above restrictions or exceptions may not apply to you.
7. After Apple notifies you that the product has been repaired and is ready for delivery, if you fail to collect the product and pay all charges payable within sixty (60) days, Apple will conclude that you have abandoned your product and granted Apple relevant rights, allowing Apple to dispose of your abandoned product in any way it deems appropriate according to applicable laws. Apple may use the proceeds derived from the sale or disposal of your abandoned product to pay any money you owe Apple.
8. If repair services involve the transmission of information or the installation of software, you represent that you have the legal right to copy the information and agree to the terms of the software license, and you authorize Apple to transmit the information for you and accept such terms when performing the repair services.
9. These Terms are governed by the laws of Taiwan (any part that conflicts with the provisions of such laws shall be deemed invalid).
10. These Terms are the sole and only terms that govern Apple's performance of repair services for your product.
11. You agree and understand that Apple must collect, process and use your personal information in order to perform repair services according to these Terms and Conditions. Apple will protect your information according to the "Apple Privacy Policy" at www.apple.com/legal/privacy/tzh/.
